This document is an electronic record in terms of Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 that require publishing the rules and regulations, Information Security and Privacy Policy and Terms of Use for access or usage of www.gogreenguru.com, www.gogreenguru.in, www.gogreenguru.org websites.

The domain names www.gogreenguru.com www.gogreenguru.in, www.gogreenguru.org (hereinafter referred to as “Website” or “Websites”) is owned by Go Green Guru Sustainability Solutions Private Limited, a private company incorporated under the Companies Act, 2013 and having its registered office at C9, Organo Naandi, H#4-61, Sy#146-152, Venkapally-Bakaram Road, Aziz Nagar, Himayath Nagar PO, Hyderabad-500075 (hereinafter referred to as “GoGreenGuru”)

These Terms of Use (“Terms”) including the applicable policies which are incorporated herein by way of reference, govern your access to and use of our current or future services, including our various resources, services, products, tools, SMS, APIs, email notifications, applications, buttons, widgets, ads and commerce services (collectively, the “Services”), and any information, text, links, graphics, photos, images, audio, videos, infographics, animations, training materials or other materials or arrangements of materials uploaded, downloaded or appearing on the Services (collectively referred to as “Content”). By mere access/use of the Services you agree to be bound by these Terms and you shall be contracting with Go Green Guru Sustainability Solutions Private Limited and these terms and conditions including the policies constitute your binding obligations, with GoGreenGuru. These Terms affect your legal rights and obligations. If you do not agree to be bound by all of these Terms, do not access or use the Services.

There may be times when we offer a special feature that has its own terms and conditions that apply in addition to these Terms. In those cases, if there is any conflict between the terms specific to the special feature and these Terms, then such special terms shall override these Terms.

For the purpose of these Terms, wherever the context so requires ‘You’ or “User” or “Subscriber” or “Customer” shall mean any natural or legal person who accesses or browses or surfs the Website(s) or has agreed to become a member of the Services by providing Registration Data while registering on the Services as Registered User using the computer systems or mobile phones. GoGreenGuru allows User to surf the Services without registering on the Services. The term “we”, “us”, “our” shall mean Go Green Guru Sustainability Solutions Private Limited.

When you use any of the Services, including but not limited to, browsing, reading, viewing, listening, giving reviews, feedbacks or comments, posting content, participating in discussions, shopping and purchasing products and services, buying subscriptions, etc. on the Websites or attending events, trainings, seminars, webinars and workshops, etc. through the Websites, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into these Terms and shall be considered as part and parcel of these Terms. As long as you comply with these Terms, We grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Services.

ACCESSING, BROWSING OR OTHERWISE USING THE WEBSITE(S) INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these Terms, you also accept and agree to be bound by the GoGreenGuru Information Security and Privacy Policy.

ARBITRATION NOTICE: EXCEPT IF YOU OPT-OUT AND EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THE ARBITRATION SECTION BELOW, YOU AGREE THAT DISPUTES BETWEEN YOU AND GOGREENGURU WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Account, Password and Security

Who May Use the Services

Use of the Services is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Services. If you are a minor i.e. under the age of 18 years, you shall not register as a member of GoGreenGuru and shall not transact or use our Services. As a minor if you wish to use or transact on Services, such use or transaction may be made by your legal guardian or parents on the Services. GoGreenGuru reserves the right to refuse to provide you with access to the Services if it is brought to GoGreenGuru’s notice or if it is discovered that you are under the age of 18 years.

If you are accepting these Terms and using the Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so and have the authority to bind such entity to these Terms, in which case the words “you” and “your” as used in these Terms shall refer to such entity.

Privacy

Please review our Information Security and Privacy Policy, which also governs your visit to GoGreenGuru Websites, to understand our practices. Our Information Security and Privacy Policy describes how we handle the information you provide to us when you use our Services. You understand that through your use of the Services you consent to the collection and use (as set forth in the Information Security and Privacy Policy) of this information, including the transfer of this information to Bluehost.in and/or Endurance International Group (India) Private Limited, and/or other countries for storage, processing and use by GoGreenGuru. If you object to your information being transferred or used, please do not use the website(s).

Your Account

If you use the Website(s), you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the Your Account section of the Website. GoGreenGuru reserves the right to refuse access to the Website, terminate accounts, remove or edit content at any time without notice to you.

Access to GoGreenGuru Websites

We will do our utmost to ensure that availability of the Website(s) will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the Website(s) may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction.

Services Offered

GoGreenGuru offers a number of internet-based services on their Website(s). One such Service enables Users to purchase of products, digital or downloadable products, and services, subscriptions to products, services, magazines, newsletters, blogs, etc., admissions to events, trainings, seminars, workshops, webinars, etc., (collectively, “Products”). Another Service allows the User to browse, read and contribute content including but not limited to articles, stories, poetries, guides, interviews, reviews, comments, links, and to browse, contribute, view and/or listen to audio-visual content including but not limited to images, photos, artworks, audio clips, podcasts, videos, animation, graphics, infographics, etc., and related links (collectively, “Content”). The Website(s) also offers the Service to form, contribute or participate in social community groups and forums, post or share information, Content, or links to Content, start or participate in discussions, raise questions or provide answers to questions raised, conduct and publish opinion polls, organize petitions and solicit online support for petitions, organize, promote or participate in events, drives, workshops, training, seminars, webinars etc., (collectively, “Groups & Forums”) .

Using the Services

Please review the GoGreenGuru FAQs, Submission Guidelines and FAQs, Community Guidelines which are part of the Terms of Use Agreement and outline what is allowed and what is prohibited on the Services. You may use the Services only in compliance with these Terms and all applicable laws, rules and regulations.

Our Services evolve constantly. As such, the Services may change from time to time, at our discretion. We may stop (permanently or temporarily) providing the Services or any features within the Services to you or to users generally. We also retain the right to create limits on use and storage at our sole discretion at any time. We may also remove or refuse to distribute any Content on the Services, limit distribution or visibility of any Content on the service, suspend or terminate users, and reclaim usernames without liability to you.

In consideration for GoGreenGuru granting you access to and use of the Services, you agree that GoGreenGuru and its third-party providers and partners may place advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others. You also agree not to misuse our Services, for example, by interfering with them or accessing them using a method other than the interface and the instructions that we provide. You may not do any of the following while accessing or using the Services: (i) access, tamper with, or use non-public areas of the Services, GoGreenGuru’s computer systems, or the technical delivery systems of GoGreenGuru’s providers; (ii) probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures; (iii) access or search or attempt to access or search the Services by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by GoGreenGuru (and only pursuant to the applicable terms and conditions), unless you have been specifically allowed to do so in a separate agreement with GoGreenGuru (NOTE: crawling the Services is permissible if done in accordance with the provisions of the robots.txt file, however, scraping the Services without the prior consent of GoGreenGuru is expressly prohibited); (iv) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive or false source-identifying information; or (v) interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, denial of service attacks, flooding, spamming, mail-bombing the Services, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Services. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of GoGreenGuru, its users and the public. GoGreenGuru does not disclose personally-identifying information to third parties except in accordance with our Information Security and Privacy Policy.

If you use advertising features of the Services, you must agree to our GoGreenGuru Master Services Agreement (https://gogreenguru.com/ads-terms).

Terms for Services and Content

You are responsible for your use of the Services and for any Content you provide, including compliance with applicable laws, rules, and regulations. You should only provide Content that you are comfortable sharing with others.

Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabelled or are otherwise deceptive. Sale/ Purchase of Products

The Products can be purchased through the Website(s) through various methods of payments offered. The sale/purchase of Products shall be additionally governed by specific policies of sale, like Cancellation policy, Exchange policy, Returns & Refunds policy, Shipping Policy etc. (which are found under the Information tab on the footer of the Website(s) and all of which are incorporated here by reference). It is clarified that at the time of creating a return request, Users are required to confirm (via a check box click) that the Product being returned is unused and has the original tags intact. If the Product returned by the User is used, damaged or if the original tags are missing, the User’s return request shall be declined, and the said Product shall be re-shipped back to the Customer. In the event that the return request is declined, the User shall not be eligible for a refund, and GoGreenGuru assumes no liability in this regard. Further, in the event that the User fails to accept the receipt of the said re-shipped Product, the User shall continue to be not eligible for a refund, and GoGreenGuru assumes no liability with respect to the return or refund for the said re-shipped Product. In addition, these Terms of Use may be further supplemented by Product specific conditions, which may be displayed with that Product.

Your Rights and Grant of Rights in the Content

You retain your rights to any Content you submit, post or display on or through the Services, unless the content is generated as part of employment, internship or contract or any such arrangement. What’s yours is yours — you own your Content (and your incorporated audio, photos and videos are considered part of the Content). If the content is generated as part of the employment, internship, internship, contract, work for hire, or paid assignment, then the copyright of the content rest with GoGreenGuru.

By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods now known or later developed (for clarity, these rights include, for example, curating, transforming, and translating). This license authorizes us to make your Content available to the rest of the world and to let others do the same. You agree that this license includes the right for GoGreenGuru to provide, promote, and improve the Services and to make Content submitted to or through the Services available to other companies, organizations or individuals for the syndication, broadcast, distribution, promotion or publication of such Content on other media and services, subject to our terms and conditions for such Content use. Such additional uses by GoGreenGuru, or other companies, organizations or individuals, is made with no compensation paid to you with respect to the Content that you submit, post, transmit or otherwise make available through the Services as the use of the Services by you is hereby agreed as being sufficient compensation for the Content and grant of rights herein.

GoGreenGuru has an evolving set of rules for how our partners can interact with your Content on the Services. These rules exist to enable an open ecosystem with your rights in mind. You understand that we may modify or adapt your Content as it is distributed, syndicated, published, or broadcast by us and our partners and/or make changes to your Content in order to adapt the Content to different media.

You represent and warrant that you have, or have obtained, all rights, licenses, consents, permissions, power and/or authority necessary to grant the rights granted herein for any Content that you submit, post or display on or through the Services. You agree that such Content will not contain material subject to copyright or other proprietary rights, unless you have necessary permission or are otherwise legally entitled to post the material and to grant GoGreenGuru the license described above.

Online Platform for Communication

You understand and acknowledge that the Website(s) is an online platform that enables you to purchase products listed on the Website(s) at the price indicated therein at any time from any location. You further understand and acknowledge that the Website(s) only enables the Users to utilise the meet and interact with one another for their transactions on the Website. You agree and confirm that GoGreenGuru is only a facilitator and is not and cannot be a party to or control in any manner any transactions on the Website.
Accordingly:
All commercial/contractual terms are offered by and agreed to between Customers and Vendors alone. The commercial/contractual terms include without limitation price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to Products and services and after sales services related to Products and services. GoGreenGuru does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Customers and Vendors.
GoGreenGuru does not make any representation or Warranty as to specifics (such as quality, value, saleability, etc.) of the Products or services proposed to be sold or offered to be sold or purchased on the Website(s).
GoGreenGuru is not responsible for any non-performance or breach of any contract entered into between the Customers and Vendors. GoGreenGuru cannot and does not guarantee that the concerned Customers and/or Vendors will perform any transaction concluded on the Website(s).
At no time shall GoGreenGuru hold any right, title or interest over the Products nor shall GoGreenGuru have any obligations or liabilities in respect of such contract entered into between Customers and Vendors.
GoGreenGuru is only a platform that can be utilized by Users to reach a larger base to buy and sell Products or services. GoGreenGuru is only providing a platform for communication and it is agreed that the contract for sale of any of the Products or services shall be a strictly bipartite contract between the Vendor and the Customer. At no time shall GoGreenGuru hold any right, title or interest over the Products nor shall GoGreenGuru have any obligations or liabilities in respect of such contract. GoGreenGuru is not responsible for unsatisfactory or delayed performance of services or damages or delays as a result of Products which are out of stock, unavailable or back ordered.
Pricing on any Product(s) as is reflected on the Website may due to some technical issue, typographical error or product information published by Vendor may be incorrectly reflected and in such an event Vendor may cancel such your order(s).
You release and indemnify GoGreenGuru and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions of the Users of the GoGreenGuru and specifically waive any claims that you may have in this behalf under any applicable law. Notwithstanding its reasonable efforts in that behalf, GoGreenGuru cannot take responsibility or control the information provided by other Users which is made available on the Website.

License for Website Access

Subject to your compliance with these Terms of Use and payment of applicable fees, if any, Go Green Guru Sustainability Solutions Private Limited grants you a limited licence to access and make personal use of this Website, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Go Green Guru Sustainability Solutions Private Limited. This licence does not include any resale or commercial use of this Website or its contents; any collection and use of any Product listings, descriptions, or prices; any derivative use of this Website or its contents; any downloading or copying of account information for the benefit of another; or any use of data mining, robots, or similar data gathering and extraction tools.

This Website or any portion of this Website (including but not limited to any copyrighted material, trademarks, or other proprietary information) may not be reproduced, duplicated, copied, sold, resold, visited, distributed or otherwise exploited for any commercial purpose without express written consent of Go Green Guru Sustainability Solutions Private Limited.

You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of GoGreenGuru Websites without express written consent. User Conduct and Rules of the Website(s)

You must not use the Website(s) in any way that causes, or is likely to cause, the Website or access to it to be interrupted, damaged or impaired in any way. You understand that you, and not GoGreenGuru, are responsible for all electronic communications and content sent from your computer to us and you must use the Website(s) for lawful purposes only.

shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider (“ISPs”) or other suppliers

You may be considered fraudulent or loss to business due to fraudulent activity if any of the following scenarios are met:
not reply to the payment verification mail sent by GoGreenGuru
fails to produce adequate documents during the payment details verification
misuse of another Users’s phone/email
use of invalid address, email and phone no.
overuse of a voucher code
use of a special voucher not tagged to the email ID used.
returns of wrong product
refuses to pay for an order
involved in the snatch and run of any order
miscellaneous activities conducted with the sole intention to cause loss to business/revenue to GoGreenGuru
with a very high return rate
repeated request for monetary compensation for fake/ used order

GoGreenGuru may cancel any order that classify as ‘Fraud orders’ under certain criteria at any stage of the Product delivery. An order can be classified as ‘Fraud Order’ if it meets with the below mentioned criteria, and any additional criteria as defined by GoGreenGuru:
Invalid address given in order details
Any malpractice used to place the order
Any order paced using a technological glitch/loophole.

You shall not use the Websites for any unlawful and fraudulent purposes, which may cause annoyance and inconvenience and abuses any policy and rules of GoGreenGuru and interrupt or causes to interrupt, damages the use by other Users of GoGreenGuru.

You shall not use any false e-mail address, impersonates any person or entity, or otherwise misleads GoGreenGuru by sharing multiple address and phone numbers or transacting with malafide intentions.

We on certain landing page even allow our Users to experience free exchange of ideas and observations regarding interest in the field of sustainability, including ‘viewing Subscriber generated content’ and/or ‘videos’ and ‘posting comments’. By accessing, viewing and/or posting any Subscriber generated content to any specific dedicated page on the Website, you accept and consent to the practices described in these ‘Terms of Use’ and ‘Information Security and Privacy Policies’, as well as any other terms of prescribed by the GoGreenGuru on the Website. You agree and undertake that when accessing, viewing and/or posting any Subscriber generated content on these pages you will not imitate, abuse, harass, any Subscriber/ User or violate and exploit, any of these ‘Terms of Use’ of the Website.

You shall not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Website or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Website. We reserve Our right to bar any such activity.

You shall not attempt to gain unauthorized access to any portion or feature of the Website, or any other systems or networks connected to the Website or to any server, computer, network, or to any of the services offered on or through the Website, by hacking, password “mining” or any other illegitimate means.

You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity

You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable domestic laws, rules and regulations (including the provisions of any applicable Exchange Control Laws or Regulations in force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to GST, Income Tax, local levies) regarding Your use of Our Service and Your listing, purchase, solicitation of offers to purchase, and sale of Products or services. You shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force.

From time to time, You shall be responsible for providing information relating to the Products or services proposed to be sold by You. In this connection, You undertake that all such information shall be accurate in all respects. You shall not exaggerate or over emphasize the attributes of such products or services so as to mislead other Users in any manner.

The Content posted does not necessarily reflect GoGreenGuru views. In no event shall GoGreenGuru assume or have any responsibility or liability for any Content posted or for any claims, damages or losses resulting from use of Content and/or appearance of Content on the Website. You hereby represent and warrant that You have all necessary rights in and to all Content which You provide and all information it contains and that such Content shall not infringe any proprietary or other rights of third parties or contain any libellous, tortious, or otherwise unlawful information.

Delivery Related – User agrees and acknowledges that any claims regarding order delivery (including non-receipt/ non-delivery of order or signature verification) shall be notified to GoGreenGuru within 7 days from the alleged date of delivery of product reflecting on the GoGreenGuru portal. Non notification by You of non-receipt or non-delivery within the time period specified shall be construed as a deemed delivery in respect of that transaction. Cart Notification

You understand that, in the event selected Products in your cart is out of the inventory, GoGreenGuru provides You an option in your cart to select the product of another Vendor, You understand that price of the Product by another Vendor may differ.

Multiple Vendors

You understand that products of a particular category/ description may be sold on the Website by multiple Vendors and the product price on the listing page of the Website, may not always reflect the lowest price for that particular category/ description. This is because the Vendor whose price is displayed on the list page is selected based on the application of a number of parameters and price is only one such parameter. However, once you land on the product display page on the Website for a specific category/ description, You will have access to the price offered by all Vendors on the Website for the relevant category/ description.

Convenience Fee

Subject to the Terms of Use and the below terms and conditions, GoGreenGuru may levy a convenience fee on all low value orders on the Website, as detailed in FAQ and for cases provided under point 5 below, hereinafter collectively referred to as “Convenience Fee”.

To protect the rights of Customers, GoGreenGuru reserves the right to collect Convenience Fee for all orders and disable cash on delivery option for accounts which have high percentage of returns and shipments not accepted, of the number of orders placed through such accounts.
